Advisory Opinion request from Coley Johnson, former employee of the Dept. of Transportation and Development, regarding post employment restrictions.
Facts:
Coley Johnson was employed by the DOTD, Office of Operations, within the Intelligent Transportation Systems Section ("Section 56 ITS") as an ITS Technician Manager. He reported to Section 56 ITS Engineer Administrator Josh Harrouch. Mr. Johnson retired from his employment on January 5, 2024.
DOTD Section 56 ITS contracts with vendors to install fiber boxes that are broken. Mr. Johnson would like to perform these services for Section 56 ITS. Mr. Johnson stated that he did not perform any such installation services while employed by DOTD Section 56 ITS and that he was not responsible for approving the contracts with vendors to perform any such services. Mr. Johnson asks whether the Code prohibits him from contracting with Section 56 ITS to install fiber boxes following his retirement from DOTD
Law:
La. R.S. 42:1121B: No former public employee shall ... for a period of two years following the termination of his public employment, render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1102(20.1) defines "service" as the performance of work, duties, or responsibilities.
Recommendations:
Adopt the proposed advisory opinion.
