Advisory Opinion request from Antonette Cannon, an employee of the Calcasieu Parish School Board, regarding her providing dyslexia evaluations to private school students.
Facts:
Antonette Cannon is employed by the Calcasieu Parish School Board ("CPSB") as an educational diagnostician in the Pupil Appraisal Department. In her role, she evaluates students to determine if the student meets the criteria for having an Individuals with Disabilities Education Act ("IDEA") disability which would qualify them to receive services through CPSB. Since dyslexia is not a categorical disability under IDEA, CPSB does not perform evaluations solely for dyslexia. As a result, students in private schools are exclusively evaluated by private entities, with any areas of deficit to be addressed during private tutoring sessions.
Ms. Cannon asks whether she may perform dyslexia evaluations on private school students. These evaluations would be performed outside of her normal hours as a CPSB employee and would not utilize CPSB-owned instruments and testing equipment.
Law:
La. R.S. 42:1111C(1)(a): No public servant shall receive any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt the proposed advisory opinion.
