RE:
Advisory Opinion request from Sandra Walker, an employee of the Monroe Police Department, regarding the donation of items by a reserve officer.
Facts:
Raja Abas is a reserve officer with the Monroe Police Department. He is also the owner of the local business The Aurum Place. Mr. Abas would like to donate a Keurig coffee maker and an air fryer for use at the Monroe Police Department dispatch center.
Law:
La. R.S. 42:1113A(1)(a): No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
La. R.S. 42:1123(30): This part shall not preclude a public servant, a legal entity in which he has a controlling interest, or a member of his immediate family, from donating services, movable property, or funds to his agency.
Recommendations:
Adopt the proposed advisory opinion.
