Advisory opinion request regarding the receipt of a meal voucher from a vendor to attend a virtual lunch and learn.
Facts:
Frank Henchy is employed with the City/Parish of East Baton Rouge in the Information Services Department. Mr. Henchy received an invitation from Dell Technologies, a city/parish vendor, to attend a virtual Lunch and Learn Webinar on Thursday, March 7, 2024, from 12:00 p.m. to 1:00 p.m. The invitation provided that customers who attend the webinar presentation on Dell's Premier Account Management and Procurement tool/platform will be sent a $30.00 Uber Eats voucher following the webinar.
Law:
La. R.S. 42:1111A(1)(a) prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

La. R.S. 42:1115A(1) prohibits a public servant from soliciting or accepting, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to have a contractual, business or financial relationship with the public servant's agency.

La. R.S. 42:1115.1 provides that the total value of the food, drink, or refreshment given to a public servant at any single event shall not exceed fifty dollars.

Recommendations:
Decline to render opinion due to past conduct.
