RE:
Request for an advisory opinion regarding whether the Code of Governmental Ethics ("Code") permits members of the Louisiana State Board of Examiners for Sanitarians ("LSBES") to receive payment for services to handle the administrative duties of LSBES.
Facts:
Board members of LSBES each receive a $100 honorarium per meeting plus travel expenses. LSBES does not currently have any employees and does not intend to have any in the future. LSBES asks whether one of the Board members of LSBES could receive payment for services to handle the administrative duties (paperwork, mail, finances, etc.) for the LSBES. If so, is there is there a maximum/yearly payment requirement? LSBES further asks that if a Board member cannot be paid to perform administrative services, can a person not on the Board be paid as a fee for services. If so, is there a maximum/yearly payment requirement?
Law:
La. R.S. 42:1113B provides that no appointed member of any board or commission, member of his immediate family, or legal entity in which he has a substantial economic interest shall bid on or enter into or be in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.
Recommendations:
Adopt the proposed Advisory Opinion.
