Request for an advisory opinion regarding whether the Code of Governmental Ethics ("Code") permits an employee of Verizon to invite her mother of the Department of Children and Family Services ("DCFS") on a trip provided by Verizon.
Facts:
Tatrina Prudhomme is an employee of DCFS. Ms. Prudhomme is an Economic Stability Supervisor in Natchitoches Parish. Ms. Prudhomme's daughter, Ta'Kerria Nichole Kahey, works for Verizon. In recognition of her sales, Ms. Kahey has won a trip to Puerto Rico and is allowed to invite one guest on the trip. Ms. Kahey has asked her mother to accompany her on the trip. Verizon has a contract with DCFS, and the contract is agency-wide. The issue is whether Ms. Kahey can gift her mother a trip to Puerto Rico that she won from Verizon.
Law:
La. R.S. 42:1115A. No public servant shall solicit or accept, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person: (1) Has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.
Recommendations:
Adopt the proposed Advisory Opinion.
