Request that the Board waive the $540.00 campaign finance late fee assessed against Kevin Bates, an unsuccessful candidate for State Representative, 20th Representative District in the October 14, 2023 election, whose 10-G campaign finance disclosure report was filed 9 days late.
Facts:
Kim Kimbrough, treasurer/report preparer for Kevin Bates, requests a waiver and states the following: After losing the primary, Ms.Kimbrough spoke with their local "expert" who had been assisting with the reporting process. He incorrectly advised that the 40-G would be the next and final report. After receiving the delinquency notice, they immediately contacted the BOE and filed that same day. Every effort has been made to submit each report timely. Please waive the assessed late fee.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
