Request that the Board waive the $1,000 campaign finance late fee assessed against Joshua Ebarb, an unsuccessful candidate for Councilman, District 5, Livingston Parish, in the October 14, 2023 election, whose 10-G campaign finance disclosure report was filed 110 days late.
Facts:
Joshua Ebarb requests a waiver and states the following: He is a first-time candidate and attempted to do everything himself to the best of his ability. He lost the election and spent most of his personal money. Mr. Ebarb received two donations during the entire campaign, which was reported on the 10-P report. After that report was submitted, he lost the election and believed he turned in everything since there weren't any additional expenses or donations. Later, he received the delinquency notice to file his 10-G report, which he filed the next business day. His mistake was believing that since the information was included in his previous report, nothing else needed to be done. Mr. Ebarb would like to apologize for this rookie mistake and request that you reduce or waive the assessed late fee.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

Recommendations:
Suspend all but $160 based on future compliance.
