Advisory Opinion regarding whether the Code of Governmental Ethics ("Code") permits Deputy Brandon J. Oubre to be employed with the Patrol Division of the St. Charles Parish Sheriff's Office while his father serves as Captain over the Patrol Division.
Facts:
Captain Bostick asks on behalf of the Sheriff's Office for the approval of a Disqualification Plan for the future assignment of Deputy Brandon J. Oubre ("Deputy Oubre") to the Patrol Division. Deputy Oubre's father, Captain Richard Oubre ("Captain Oubre"), is the Captain of the Patrol Division. Major Donnie Smith supervises the entire Patrol Division, and Captain Oubre is second in command. The Sheriff's Office wishes to consider the assignment of Deputy Oubre to the Patrol Division and has submitted the following Disqualification Plan for approval.

As with all deputies, decisions regarding disciplinary actions, promotions, and salary increases are made by Chief Deputy Joseph Ganote and Sheriff Greg Champagne. In addition, all deputies in the Patrol Division are directly supervised by Sergeants and a Lieutenant. As a further precaution, Captain Oubre will be specifically instructed in writing by Chief Deputy Ganote that he is not to be involved with the employment of his son in matters affecting supervision, discipline, promotions, and salary increases.

Law:
La. R.S. 42:1112B. No public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any of the following persons has a substantial economic interest:

(1) Any member of his immediate family.

La. R.S. 42:1112C. Every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1).

La. R.S. 42:1119A. No member of the immediate family of an agency head shall be employed in his agency.

Recommendations:
Adopt the proposed Advisory Opinion.
