Walter Krause serves as the Mayor for the Village of Sicily Island. His son, Mark Krause, is currently an elected Alderman for the Village of Sicily Island. If Mark Krause resigns from his position as an Alderman, he may seek employment as a police officer for the Village of Sicily. The issue is whether the Code of Governmental Ethics permits Mark Krause to be employed as a police officer for the Village of Sicily Island while his father, Walter Krause, serves as the Mayor.

La. R.S. 42:1119B(1). No member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity.
La. R.S. 42:1121A(2). No former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
