SEAP is an advisory board under the jurisdiction of the Louisiana Department of Education, pursuant to state and federal law. BESE informed members of SEAP via email on February 24, 2024 that they may be removed from their positions on SEAP.

Rule 601 of the Rules for the Louisiana Board of Ethics provides that
the Board shall receive requests for advisory opinions filed with it by "affect
persons." Further, Rule 601 provides that the Board may decline to render an
opinion with regard to any such request. Rule 101.B defines "affected person"
to mean any person or governmental agency, or the authorized representative of
such persons or agency with a demonstrable and objective interest in the
Board's interpretation, construction, and application of any law within the
Board's jurisdiction.
