RE:
Advisory Opinion request from James Gravois as to whether the Code of Governmental Ethics ("Code") prohibits LA Athletics from providing services to students who are members of the Dutchtown High School cheerleading team.
Facts:
LA Athletics is a gymnastics training facility that offers training and skills lessons to children of all ages. Dutchtown High School pays LA Athletics for access to the facility and training of students on the Dutchtown High School cheerleading team, which is under the supervision of Coach Michelle Bogran. Mr. Gravois is not an employee of Dutchtown High School or the Ascension Parish School Board. Mr. Gravois asks whether LA Athletics can provide private training services directly to the members of the Dutchtown High School cheerleading team.
Law:
La. R.S. 42:1111C(1)(a): No public servant shall receive anything of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
La. R.S. 42:1102(19) defines "public servant" to include a public employee or elected official.
La. R.S. 42:1102(18)(a) defines "public employee" as anyone, whether compensated or not, who is:
(ii) Appointed by any elected official when acting in an official capacity, and the appointment is to a post or position wherein the appointee is to serve the
governmental entity or an agency thereof, either as a member of an agency, or as an employee thereof;
(iii) Performing a governmental function;
(iv) Under the supervision or authority of an elected official or another employee of the governmental entity.
Recommendations:
Adopt the proposed advisory opinion.
