Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Christopher Guilbeaux to serve as the Executive Director of Louisiana Emergency Preparedness Association ("LEPA") following his retirement from the Office of Homeland Security and Emergency Preparedness ("GOHSEP").
Facts:
Mr. Guilbeaux recently served as the Assistant Deputy Director of Emergency Management for GOHSEP until his retirement on January 20, 2023.

He currently serves as the owner and CEO of a small consulting business, DECON SOLUTIONS, INC. He is also conducting paid consulting and business development for Hunt, Guillot, and Associates ("HGA") for a set monthly fee. He also serves as the Executive Director of the Louisiana Emergency Preparedness Association (LEPA), a private non-profit organization. The position is currently non-paid. However, there may be potential funding and a monthly consulting fee to conduct the executive director function for the association.

He asks whether he is allowed to serve as and receive compensation as Executive Director of LEPA while remaining as a consultant for HGA as well as potentially other private companies.

Law:
La. R.S. 42:1121A(1) No former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed Advisory Opinion.
