In May 2023, Kimberly Walker McAlister was the Dean of the College of Education and Human Development, which included serving on the Louisiana School for Math, Science, and Arts Board of Directors. She was Immediately replaced once she submitted her intent to retire from Northwestern State University (LSMSA). The last meeting she attended was in April 2023, and it is customary for a file reminder to be given at the June LSMSA Board meeting. On 8/1/2023, she began a temporary appointment in Texas, although she still lived in Louisiana. She was working in Texas when the FTF notice was received. Her husband picked up the notice on 1/24/2024 and did not open it until 2/2/2024. On 2/12/2024, she found the disclosure online and mailed the statement. On 2/28/2024, she spoke with a BOE representative who explained that the report needed to be amended. She downloaded the disclosure but failed to upload it. She filed electronically the next day. It was confirmed that other documents had been received on 2/28/2024 and 2/29/2024. Ms. McAlister acknowledges the neglect on her end but respectfully requests a waiver of the assessed late fee.

La. R.S. 42:1121.2.1
requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Suspend all but $250 based on future compliance with the Code of Ethics. The $250 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
