RE:
Request that the Board waive the $2,500.00 campaign finance late fee assessed against Tess Percy Stromberg, a successful candidate for Judge, Court of Appeal, 1st Circuit, 1st Dist., Elec. Sec. 1, Division C in the March 23, 2024 election, whose 90-P campaign finance disclosure report was filed 49 days late.
Facts:
Judge Tess Percy Stromberg requests a waiver and states the following: In the special election, she was the sole candidate who qualified and won. She neither received nor spent any campaign funds. She was initially expected to take her seat at the First Circuit on January 1st, 2024. However, she pledged to preside over a week-long murder trial before assuming her seat on January 21st, 2024. After the election, she focused on the trial. This was her first late filing in her third election. She believes that the timing of the special election, which occurred at the end/beginning of the year, and her minimal campaigning contributed to her oversight. She submitted the report promptly after realizing the mistake.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $1,000 based on Rule 1205C; decline to waive.
