RE:
Request that the Board waive the $1,000.00, $1,000, $1,000 and $440.00 campaign finance late fees ($3,440.00 total) assessed against Earnestine "Tina" Horn, an unsuccessful candidate for Police Juror, District 5. Cameron Parish, in the October 14, 2023 election, whose 30-P, 10-P, 10-G and 40-G campaign finance disclosure reports were filed 141, 121, 86 and 11 days late, respectively.
Facts:
Earnestine "Tina" Horn requests a waiver and states the following: She ran for public office to serve her parish. She had no campaign contributions and paid all her expenses out-of-pocket. Ms. Horn states that the reporting system is confusing and does not understand the requirements. She did her best to file timely. Her intention was never to hide anything from the public. Ms. Horn believed she did a decent job reporting her expenditures and had no campaign contributions. She would like to thank you for your consideration.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
With respect to 30-P and 40-G, decline to waive.

With respect to 10-P, reduce to $432 based on Rule 1205C; decline to waive.


With respect to 10-G, reduce to $577 based on Rule 1205C; decline to waive.
