RE:
Request that the Board waive the $1,000.00, $1,000.00 and $480.00 campaign finance late fees ($2,480.00 total) assessed against Mary A. Giles, an unsuccessful candidate for Police Juror, District 10, Bossier Parish in the October 14, 2023 election, whose 10-P, 10-G and 40-G campaign finance disclosure reports were filed 76, 62 and 12 days late, respectively.
Facts:
Mary Giles requests a waiver and states the following: She is a first time candidate who misinterpreted the written directions and needed help. She was confused about reporting her funds and filing a report if the donations did not exceed $200. She became despondent when campaign signs were removed under false pretenses and didn't know what to do. Being in the runoff and no longer having funds to compete was also an issue. The lack of funds contributed to her inability to contest the election. Ms. Giles spoke to a BOE representative but asked the wrong questions. Ms. Giles regrets her actions and would like to apologize. Hopefully, leniency will be given, and the late fee will be waived.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:


With respect to 10-P and 10-G, decline to waive.


With respect to 40-G, reduce to $400 based on Rule 1205C; decline to waive.
