Request for approval of a disqualification plan on behalf of Red River Parish School District regarding the employment Krystle and Fonda Mosely.
Facts:
Katie Bethard is the Director of Nutrition and Health for Red River Parish Schools. Ms. Bethard oversees the cafeteria workers for the four schools in Red River Parish.
Fonda Mosely has been employed as a cafeteria worker at Red River Elementary School for 16 years. Her daughter, Krystle Mosely, has been an approved substitute cafeteria worker for approximately three years. Fonda Mosely is now one of two managers at Red River Elementary School, with the other manager being Jasmine Williamson.
To avoid a potential conflict of interest, Red River Parish School District has proposed that all matters involving Krystle Mosely's employment, including the decision of which school she is assigned to work, will be handled by either Jasmine Williamson if it involves Red River Elementary or Ms. Bethard if it involves another school.
Law:
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction in which his immediate family member has a substantial economic interest. La. R.S. 42:1102(21) defines "substantial economic interest" as an economic interest which is of greater benefit to the public servant or other person than to a general class or group of persons.
La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in a transaction involving the governmental entity when a violation of the Code would result.
Recommendations:
Adopt the proposed advisory opinion.
