Advisory opinion request regarding the post-employment restrictions for a former employee of the Vermilion Parish Sheriff's Office. |

Kirk Frith was employed with the Vermilion Parish Sheriff's Office ("VPSO") for over 40 years. For the last nineteen (19) years, Mr. Frith served as the VPSO's Chief Deputy and Warden. As Chief Deputy, he was responsible for assisting the Sheriff with the general operation, administration, and management of the Sheriff's Office, which included policy-making, budgetary matters, and employee management. As Warden, he was responsible for the Correctional Division, which included the parish jail and employees. Mr. Frith's last day of employment with the VPSO was September 30, 2023.
In the future, Mr. Frith would like to contract with the VPSO to provide risk management consulting services on an as-needed basis for all divisions of the VPSO, including the Correctional Division. Mr. Frith would give input and guidance on the agency's policy and procedures, conduct annual reviews of property and injury loss incidents, and perform onsite inspections for safety and compliance as requested by the Sheriff and upper command staff only.
Mr. Frith asks for guidance as to whether he is permitted to contract with the VPSO to provide risk management consulting services within the two-year period following the termination of his public service with the VPSO.

La. R.S. 42:1121A(1) provides that no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that former agency or render any service on a contractual basis to or for such agency.
