Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Todd Eppley to provide services to Inframark, LLC, following his retirement from the Plaquemines Parish Government.
Facts:
Todd Eppley served as the former Director of Public Service for the Plaquemines Parish Government ("PPG"). His last day of employment with PPG was December 31, 2022. PPG contracts with Inframark, LLC to provide operational services for PPG's public water system. In his role as the Director of Public Service, Mr. Eppley exercised oversight and management of Inframark's contract with PPG. The Superintendent of PPG's water billing department also reported to Mr. Eppley during his tenure as the Director of Public Service. Mr. Eppley exercised general authority over the water billing department and processed and made decisions regarding water billing customer appeals, in consultation with PPG's legal department. Inframark, LLC is currently negotiating with PPG to provide water billing services by contract. If that contract is signed, Inframark has asked Mr. Eppley to consider being an employee, managing their water billing services division, which would include providing services to PPG.
Law:
La. R.S. 42:1121A(1). No former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed Advisory Opinion.
