Request to reconsider the Board's decision to decline to waive a $1,050 late fee assessed against Stacey King, former member of the West Feliciana Parish Tourist Commission, for filing her 2021 Tier 2.1 annual pfd 21 days late.
Facts:
Initial Request


Stacey King left town on September 4th, 2023. When she returned home on 10/17/2023, she found a certified late fee notice in her mailbox that she did not sign for. Ms. King volunteer on the West Feliciana Tourism Board from February 2019 to late 2021. She was not informed to file her 2021 PFD until she received a delinquency notice, which she also did not sign for. After filing her disclosure on 04/26/2023, Ms. King states that a BOE representative confirmed receipt and stated that no penalty was owed. Ms. King did not receive any further notice until she received the late fee notice. As a government official, she relied on the parish secretary to remind her to file. Given the above mentioned circumstances, she believes she would not be penalized.

Reconsideration

Ms. King states her term ended in December 2021 which explains why she was not reminded by her former board.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance.
