Request to reconsider the Board's decision to decline to waive a $2500 late fee assessed against Erika L. Green, former member of the Metro Council / District 5 / East Baton Rouge Parish, regarding a $2500 late fee assessed for filing her 2021 Tier 2 annual pfd 35 days late.

Erika Green has acknowledged that the disclosure was filed late, but she wishes to clarify that her delay was due to her being occupied with her current position and candidacy for another role in 2022. She believed that the filing had already been submitted. She has explained that the proposed $2,500 fine would cause her financial distress. Ms. Green had to shut down her law office in late 2021.The transition to her new job has unexpectedly caused some personal financial difficulties. She would like to express her regret for the late filing, thank you for your understanding, and kindly request a waiver of the late fee.

Judge Green reasserts her initial reasons.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Affirm prior decision to decline to waive.
