Untimely request that the Board waive the $1,320 and $120 campaign finance late fees ($1,440 total) assessed against Dexter T. Lathan, an unsuccessful candidate for State Senator, 22nd Senatorial District in the October 14, 2023 election, whose 30-P and 10-P campaign finance disclosure reports were filed 22 and 2 days late, respectively. AND Timely request the the Board waive the $300 campaign finance late fee assessed against Dexter T. Lathan, an unsuccessful candidate for State Senator, 22nd Senatorial District in the October 14, 2023 election, whose 10-G campaign finance disclosure report was filed 5 days late.
Facts:
Dexter T. Lathan requests a waiver and states the following: He received help to amend his reports due to his lack of knowledge of the system. He forgot about the 10-G. He filled out the form but did not hit the submit button. After losing the election, Mr. Lathan was experiencing financial issues and was trying to make ends meet. He would like to apologize for this mishap.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Consider untimely request for 30-P and 10-P reports.

With respect to 30-P, reduce to $600 based on Rule 1205C; suspend all but $200 based on future compliance.

With respect to 10-P, decline to waive.


With respect to 10-G, suspend all but $200 based on future compliance.
