Advisory Opinion request from Joseph Dominick, Executive Director of the Florida Parish Juvenile Detention Center, whether he can provide private consulting services to other governmental entities. |

The Florida Parishes Juvenile Justice District ("District") was established by La. R.S. 15:1094 as a political subdivision of the State of Louisiana, with a territorial jurisdiction covering the 21st and 22nd Judicial District, which include the parishes of Livingston, St. Helena, St. Tammany, Tangipahoa, and Washington. The District is governed by the Florida Parish Juvenile Justice Commission, which operates the Florida Parishes Juvenile Detention Center in Covington. Joseph Dominick is the Executive Director of the Juvenile Detention Center. Mr. Dominick asks whether he can provide private consulting services to other governmental entities outside of the District's jurisdiction, including other judicial districts, parishes, the State of Louisiana, or other states. The services would consist of regional juvenile placement facility development, juvenile justice reform, and public administration consultation. Mr. Dominick stated that he does not currently provide any of these services as part of his duties as Executive Director. Mr. Dominick further stated that his consultation services would not occur during his regular work hours or that he would take the required annual leave if necessary.

La. R.S. 42:1113(A)(1)(a): No public servant … or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant. La. R.S. 42:1102(2)(a) defines "agency" as a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity. La. R.S. 42:1102(18) defines "public employee" as any individual who is an administrative officer or official of a governmental entity who is not filling an elective office. La. R.S. 42:1102(19) defines "public servant" as a public employee or elected official.
