Advisory Opinion request from Lynn Hebert on behalf of the Terrebonne Parish Department of Planning & Zoning as to whether the Code prohibits employees from accepting a gift from a contractor.
Facts:
ARES Construction is a contractor that does business with the Terrebonne Parish Department of Planning & Zoning ("Planning Dept."). ARES Construction delivered a set of ten sublimation tumbler cups to the employees of the Planning Dept. The 20 oz. tumblers contain the logo of ARES Construction.
Law:
La. R.S. 42:1115A(1): No public servant shall solicit or accept, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.
La. R.S. 42:1102(22)(a) defines "thing of economic value" to mean money or any other thing having economic value, except promotional items having no substantial resale value.
Recommendations:
Adopt the proposed advisory opinion.
