Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Anthony Dillon to form an LLC to offer code enforcement consulting to political subdivisions of the State of Louisiana and/or out of state political subdivisions while he is employed as the Chief Compliance Inspector for St. Bernard Parish. |

Anthony Dillon currently serves as the Chief Compliance Inspector for the St. Bernard Parish Government. His current job duties consist of oversight and supervision of all employees, aspects, and functions of the Code Enforcement division for the St. Bernard Parish Government. His duties include, but are not limited to, reviewing and applying local code ordinance provisions and regulations to determine the best corrective actions regarding code violations. Mr. Dillon also drafts and amends provisions to local code ordinances and conducts field inspections and investigations relative to possible local code ordinance violations.
Mr. Dillon is contemplating forming a private LLC to offer code enforcement consulting for compensation, outside of his normal working hours, to other political subdivisions of the State of Louisiana and/or out-of-state political subdivisions. His clients would not follow any of the code sections of the St. Bernard Parish Code of Ordinances. However, it is very likely that the ordinances for his clients' jurisdiction would be similar in substance.

La. R.S. 42:1111C(1) provides that no public servant shall receive any thing of economic value for any service, the subject matter of which:
(a) Is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated; or
(b) Draws substantially upon official data or ideas which have not become part of the body of public information.
