Waiver request submitted by Samuel Joseph "Joe" Stevenson, Bienville Board of Alderman / Bienville Parish, regarding a $200 late fee assessed for filing his 2022 Tier 3 annual pfd 8 days late.
Facts:
Samuel Joseph Stevenson moved and resigned as the Village of Bienville Alderman in 2021. His PFD was filed on time and the Village of Bienville was notified of his resignation. They should have handled the proper documentation of this matter. Mr. Stevenson had zero income to report for 2022 since he resigned in the 2021. He does not feel that he should be held liable for the assessed late fee.

Per 05/24/2024 email from the Secretary of State: Election Commission Office. there is not record of resignation on file for Samuel Joseph "Joe" Stevenson. he served until the end of his term on December 31, 2022. According to the Legislative Auditor's Report for 7/1/2020 to 6/30/2021, he earned $360. The Report for 7/1/2021 to 6/30/2022 showed he earned $330. The Report for 7/1/2022 to 6/30/2023 lists him as resigned and earning no income. Based on the reports, if he resigned, it appears he resigned in 2022.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
