Advisory Opinion request from Holly Sherman, an employee of the New Orleans Emergency Management Services, regarding the possible supervision of shifts worked by Derek Blanchard, the father of her children. |

Holly Sherman is employed with the New Orleans Emergency Medical Services ("EMS") as a field captain in which she acts as an assistant supervisor. Ms. Sherman recently switched to working day shifts. Her children's father, Derek Blanchard, is also employed by EMS as a paramedic on day shifts. Ms. Sherman is not married to Mr. Blanchard and they do not have any other relationship at this time. Ms. Sherman asks whether she can work overtime shifts, which may include supervising Mr. Blanchard's shifts.

La. R.S. 42:1112B: No public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any of the following persons has a substantial economic interest: (1) Any member of his immediate family. La. R.S. 42:1102(13) defines "immediate family" to include a public servant's children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.
