Waiver request submitted by Amanda Jane LaFleur, Council for the Development of French in Louisiana, regarding a $1500 late fee assessed for filing her 2022 Tier 2.1 annual pfd 169 days late.
Facts:
Amanda J. LaFleur has been serving on the Council for the Development of French in Louisiana Board for ten years. She submitted all other disclosures on time. However, after submitting the 2023, she was informed about the 2022 delinquency and promptly took care it. In the spring and summer of 2023, she was preoccupied with buying and selling her homes. Her husband's medical issues prevented him from assisting with the move and home repairs. Additionally, she was diagnosed with COVID-19 and experienced a relapse several weeks later. On 6/10/23, her husband had a medical emergency. Before Ms. Lafleur's hip surgery (9/14/2023) it may have been sent to her old address or misplaced. Ms. LaFleur is more diligent in overseeing the mail collection. While she acknowledges her negligence, she requests leniency given the circumstances outlined above. She is asking to have the late fee waived.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
