Waiver request submitted by Anicia Banks, Cane River Waterway Commission, regarding a $650 late fee assessed for filing her 2022 Tier 2.1 annual pfd 13 days late.
Facts:
This is Anicia Banks' first time serving and being appointed to a public office. When she was first appointed commissioner for the Cane River Waterway Commission, the administrator gave her paperwork to fill out, and she returned it. The administrator ensured it reached the state department, but she was fired a few months after Ms. Banks started. No one gave Ms. Banks the specifics on the paperwork nor the penalty for it not being turned in. Her paperwork wasn't filled out correctly or turned in. She believed the necessary documentation had been turned in when she received the notice. After checking, there was no way of knowing if she turned it in. Ms. Banks contacted the BOE to acquire the needed form. She is asking for grace due to her lack of knowledge. If she had known about the severity of submitting the disclosure, it would have been done on time.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
