Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Clifton Gremillion to work for the Headquarters Division of the Louisiana Department of Corrections after his retirement from employment with the Louisiana State Penitentiary.
Facts:
Clifton Gremillion retired from the Louisiana State Penitentiary, a state prison under the Department of Corrections, on October 18, 2020. His job duties included maintaining all electronic equipment needed for security, including beeper systems, radios, body scanners, camera systems, and electronic perimeter detection systems.

On February 18, 2021, he returned to work as a WAE for the Louisiana Department of Corrections ("DOC"), Headquarters Division, in Baton Rouge, Louisiana. His job duties include programming and deploying body cameras for various state prisons under the purview of DOC. His job title is Electronic Tech and he is employed within the Technology Management division of DOC. His job duties include installing electronic surveillance and/or perimeter detection work on any electronic devices needing to be serviced. This includes maintaining camera systems at the Louisiana Correctional Institute for Women and DOC Head Quarters in Baton Rouge. He also installs perimeter detection systems at all correctional facilities under the purview of DOC.

He asks whether he can contract directly with the Louisiana State Penitentiary or other individual state prisons to provide electronic services, including assisting in maintaining body camera systems and/or any surveillance or perimeter fence detections that need to be repaired.

Law:
La. R.S. 42:1113A.(1)(a) No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt the proposed Advisory Opinion.
