Advisory opinion regarding whether the Code of Governmental Ethics (Code) prohibits Holly Hughes, a Livingston Parish Library (LPL) employee, from donating her services to her agency.
Facts:
Ms. Hughes stated that she had been employed by LPL for many years. In the last two years she helped develop and implement the LPL Career Center. She served as Career Services Librarian 1. The LPL Career Center was closed in April 2024.

She is still employed by LPL; however, she now serves as a General Librarian at the Denham Spring-Walker branch. Her question is since LPL has discontinued the Career Center, and now only offers career services to a minimal degree through either BAL (Book a Librarian) or databases, is she prohibited from providing career facilitation services to individuals, non-profits, NGO's, and government organizational within Livingston Parish and surrounding parishes.

Law:
La. R.S. 42:1111(C)(1)(a) provides that no public servant shall receive any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated;

La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.

La. R.S. 42:1102(19) defines "public servant" to mean a public employee or elected official.

Recommendations:
Adopt draft advisory opinion.
