Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Chris Guidry to work for GEC, Inc. on the Calcasieu River Bridge Owner Verification Project after retiring from the Louisiana Department of Transportation and Development ("DOTD").
Facts:
Chris Guidry currently works as an Assistant Bridge Design Administrator with DOTD. He is employed with the Bridge and Structural Design Section of the Engineering Division of DOTD. Mr. Guidry's primary duties include overseeing and managing consultant projects and planning and project development. Mr. Guidry is being offered a position with GEC, Inc., a consulting firm, as a Senior Project Manager for the Calcasieu River Bridge Owner Verification Project ("the Project"). GEC, Inc. would contract with the Bridge and Structural Design Section of DOTD for the Project. Mr. Guidry has not worked on the Project during his employment with DOTD. However, he would be providing the same services on the Project, through GEC, Inc., that he previously provided on other projects with DOTD.
Law:
La. R.S. 42:1121B(1). No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed Advisory Opinion.
