Advisory Opinion request from Harry St. Pierre, Jr. as to whether the Code of Governmental Ethics ("Code") prohibits him from accepting a position with Hunt Guillot and Associates following his retirement from the East Baton Rouge Mayor's Office of Homeland Security and Emergency Preparedness.
Facts:
The East Baton Rouge Parish Mayor's Office of Homeland Security and Emergency Preparedness ("MOHSEP") is the coordinating agency for emergency and disaster activities for the City of Baton Rouge/Parish of East Baton Rouge ("City/Parish"). MOHSEP is governed under the Executive Branch of the City-Parish government led by the Mayor-President. Harry St. Pierre, Jr. was employed with MOHSEP as an Emergency Preparedness Coordinator with a focus on hazard mitigation grant management. MOHSEP has a contract with Hunt Guillot and Associates ("HGA") to perform management services on hazard mitigation grants.

Mr. St. Pierre retired from MOHSEP on September 27, 2024. He has since accepted employment with HGA in which he will work on contracts between HGA and the State of Louisiana. Mr. St. Pierre will not work on any projects involving MOHSEP or the City/Parish. Mr. St. Pierre stated that during his employment with MOHSEP, he did not work on any projects involving the State of Louisiana. Mr. St. Pierre asks whether the post-employment restrictions prohibit him from working on HGA projects with the State of Louisiana.
Law:
La. R.S. 42:1121B(1): No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed.

La. R.S. 42:1121C: No legal entity in which a former public servant is an officer, director, trustee, partner, or employee shall, for a period of two years following the termination of his public service, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such public servant at any time participated during his public service and involving the agency by which he was formerly employed or in which he formerly held office.
Recommendations:
Adopt the proposed advisory opinion.
