Advisory Opinion request from Caddo Parish Schools as to the application of Act 492 of the 2024 Legislative Session regarding tutoring services.
Facts:
Caddo Parish School Interim Superintendent Lisa Woolfolk seeks guidance as to the application of Act 492 to the following scenarios:
1. A drama teacher who owns an LLC and provides acting lessons to students attending her school after school at an offsite location.
2. A music teacher provides piano lesson to students after school at the school site.
3. Teachers holding week long camps in the summer at offsite locations.
4. A science or math teacher tutoring their own students after school in their classroom.
Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

ACT 492 (effective June 5, 2024): This Part shall not preclude:

(41) A teacher, coach, or other educational professional from providing academic tutoring or athletic training services for compensation to students who attend the school at which the teacher, coach, or other educational professional is assigned or the waiver of any usage fees associated with use of school facilities for these purposes.
