Untimely waiver request submitted by Ken Todd DeMoss, Bayou D'Arbonne Lake Watershed District, regarding a $1500 late fee assessed for filing his 2022 Tier 2.1 annual pfd 256 days late.
Facts:
Ken Todd DeMoss has served on the Bayou D'Arbonne Lake Watershed District Commission since 2019. He has always tried to give his best to the Lake Commission, but it falls lower on his priority list than his family and job. In 2022 and 2023, he filed Form 405 on time but was confused and did not file Form 417. Mr. DeMoss recently learned that he was sent notices regarding the error but missed them. He would never intentionally ignore filing his disclosures. Mr. DeMoss does not know the people who signed for the NOD and LFO. After receiving the Demand Letter, he contacted a BOE representative to resolve the issue and file his disclosure. Mr. DeMoss mentions that he enjoys serving on the Board, but this is a volunteer position, and he is not paid for his time. He regrets this mistake and humbly requests a late fee waiver.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
