RE:
Request that the Board waive the $1,000.00, $840.00 and $520.00 campaign finance late fees ($2,360.00 total) assessed against Travis Herrington, an unsuccessful candidate for Police Juror, District E, Rapides Parish, in the October 14, 2023 election, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 40, 21 and 13 days late, respectively.
Facts:
Travis Herrington requests a waiver and states the following: primary job is to provide essential gas services, which demands 60-70 hours a week. This, coupled with the responsibilities of being on-call as a first responder, led to an oversight of filing deadlines. His campaign was a grassroots effort. The financial burden of legal fees incurred due to challenging an opponent's qualifications further strained resources, preventing him from hiring a CPA to manage campaign finances. There was an exhaustive process of addressing potential irregularities and investigating discrepancies in mail-out ballots during the runoff election. Mr. Herrington's intention has always been to comply and has taken care of the 40-G fine. He is committed to rectifying this
oversight and ensuring timely compliance moving forward.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
With respect to 30-P, decline to waive.

With respect to 10-P and 10-G, reduce each to $400 ($800 total) based on Rule 1205C; decline to waive.
