Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Chris Guidry to work for GEC, Inc. on the Calcasieu River Bridge Owner Verification Project after retiring from the Louisiana Department of Transportation and Development ("DOTD").
Facts:
Chris Guidry currently works as an Assistant Bridge Design Administrator with DOTD. He is employed with the Bridge and Structural Design Section of the Engineering Division of DOTD. His primary duties include overseeing and managing consultant projects and planning and project development. He leads a group of structural design and roadside safety analysis and design engineers.

Mr. Guidry is being offered a position with GEC, Inc., a consulting firm, as a Senior Project Manager for the Calcasieu River Bridge Owner Verification Project ("the Project"). GEC, Inc. has contracted with DOTD for the Project. The contract was signed by the Secretary of DOTD. The Bridge and Structural Design Section of DOTD is not involved in any aspect of the Project.

The Critical Projects section of DOTD handles large complex public/private partnerships such as the Project. Mr. Guidry has had zero involvement in any aspects of the Project. The services that Mr. Guidry seeks to provide to GEC, Inc. are not the same services he provides to the Bridge and Design Structural Design Section of DOTD currently. For GEC, Inc., his job will be limited to receiving design documents and plans from a primary design team and being a focal point of distribution of subject designs and plans to the subject matter experts for their review and comment.

Law:
La. R.S. 42:1121B(1). No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed Advisory Opinion.
