Advisory opinion as to whether the Code of Governmental Ethics ("Code") prohibits Jeff Ditman, a teacher at Prairieville High School, from contracting with the Ascension Parish School District to provide track and field timing services through his business, CD Timing. |

Mr. Ditman provided that he is a teacher at Prairieville High and not a coach. He is the co-owner of CD Timing. CD Timing is a business that provides specialized track and field timing services to high school track programs to conduct fully automated timing for meets during the season. CD Timing would like to contract with Ascension Parish School District for compensation for timing meets in the Parish. Mr. Ditman stated that the equipment expense and technological knowledge needed to provide this service creates a market in which there are very few firms able to supply the demand. He believes that CD Timing being allowed to compete would be a benefit to student athletes in the Parish. Additionally, he intends to supply CD Timing at a discounted rate.

La. R.S. 42:1113A(1)(a) of the Code prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
