Advisory Opinion request regarding whether the Code of Governmental Ethics ("Code") permits the Louisiana Radiologic Technology Board of Examiners ("LSRTBE") to hire former board chairwoman Susan Guarisco.
Facts:
Recently, the longstanding chairwoman of the LSRTBE, Susan Guarisco, was not reappointed to the LSRTBE. Ms Guarisco has many years of experience in handling the administrative workings of the LSRTBE office. Due to attrition of staff, Ms.Guarisco stepped in on multiple occasions to assist with the training of staff. The LSRTBE recently hired a new Executive Director and other clerical positions to assist the LSRTBE in the execution of its mandated state duties. Unfortunately, these newly hired individuals were not fully trained in all aspects of their jobs before Ms. Guarisco's term on the LSRTBE ended. At this juncture, the LSRTBE Chairman would like to hire Ms. Guarisco to assist with completing the training of the newly hired LSRTBE staff.
Law:
La. R.S. 42:1121A(2). No former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
Recommendations:
Adopt the proposed Advisory Opinion.
