Richard Zeringue was voted on the Ascension Parish Tourism Board on 3/16/2023, and this was his first time serving on a Board. Executive Director Tracy Browning unknowingly misinformed him that since he started in 2023, he would not have to file a 2022 PFD. The 2023 PFD was submitted, but Ms. Browning was told that the Board members submitted the wrong form. Their forms were amended. Mr. Zeringue later received the 2022 Notice of Delinquency (NOD) and believed it to be referencing 2023 since it was noted that it was originally due 5/15/2023. He acknowledges it was his fault for misreading the notice. Mr. Zeringue received the Late Fee Order and spoke with a BOE representative who told him that he was required to file the 2022 PFD.

La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Suspend all but $1050 based on future compliance with the Code of Ethics. The $1050 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
