Waiver request submitted by Mandi J. Hrabley, Sewerage District #2 / St. Tammany Parish, regarding a $600 late fee assessed for filing her amended 2022 Tier 2.1 annual pfd 12 days late.
Facts:
Mandi J. Hrabley and her husband volunteer for the Sewerage Board for District#2. They maintained and fiscally managed a failing sewage system, which was a full-time task while working a full-time stressful job. Her term expired on 12/31/2023, so her obligations were fulfilled. Ms. Hrabley believes it is unreasonable to receive an amendment notice years later and only be given 7 days to complete the disclosure. Louisiana should be grateful to the individuals serving and not make compliance so daunting and fearful. Ms. Hrabley did not sign for the Notice of Delinquency (NOD). Her husband was deployed, so she was frequently away for a week or more. She was scheduled to move on 4/24/2024 and traveled between Louisiana and Arkansas when the NOD was sent.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance.
