Waiver request submitted by Adren O. Wilson, former Deputy Chief of Staff in the Office of the Governor, regarding a $12,500 late fee assessed for filing his 2022 Tier 1 annual pfd 37 days late.
Facts:
Adren O.Wilson's Late Fee Order was rerouted from his previous Chicago address to his current New Orleans address, which caused a delay in the notice being received. He did not receive the Notice of Delinquency (NOD) until 8/29/2023 because it was initially mailed to his previous Baton Rouge address and forwarded to his Chicago address, where he lived from 3/2022 to 4/2024. His job requires extensive travel, which aided in the delay in receiving the notice. The statement was immediately filed on 8/30/2024.

Law:
La. R.S. 42:1124 requires the Office of the Governor - Deputy Chief of Staff to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $700 based on future compliance with the Code of Ethics. The $700 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
