Request that the Board reconsider its decision to decline to waive a $1100 late fee assessed against Thomas L. Scott, Jr., East Baton Rouge Parish Hospital Service District No. 1 d/b/a Lane Regional Medical Center, for filing his 2021 Tier 2.1 annual pfd 22 days late.
Facts:
Mr. Meese is requesting reconsideration stating that the Board's staff has not kept track of Mr. Scott's filings, that the staff lost Mr. Scott's filing; therefore, it issued the Notice of Delinquency (NOD).


Initial Waiver Request:


As the Chief Executive Officer of Lane Regional Medical Center (Lane), Larry Meese is submitting a waiver request on behalf of Thomas L. Scott, Jr. Mr. Scott has served as the Board Chair for Lane's Board of Commissioners for six years. This is his first occurrence of an issue related to the late filing of any required forms. He is now current with his requirements. Mr. Meese would like to thank you for your consideration and kindly request a waiver of the assessed late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Affirm prior decision to decline to waive.
