RE:
Request to reconsider the Board's decision to decline to waive the $1500 late fee assessed against John K. McTear, Lake St. Joseph Recreation and Water Conservation District, for filing his 2021 Tier 2.1 annual pfd 235 days late.
Facts:
Mr. McTear states he was diagnosed with MS in 2017, which has affected his cognitive skills, along with his computer and motor skills. Mr. McTear states he is in chronic pain.


Initial Waiver Request


John McTear volunteers to serve at Lake St. Joseph Recreation and Water Conservation District and does not receive compensation for his services. He is a disabled combat veteran who is giving back to his community. The Board is supposed to consist of seven members, but for the last five years, they have only had three members, so business could not be conducted. Mr. McTear gets very little support from the Village of Newellton or the Tensas Parish Police Jury and believed the Volunteer's Protect Act would protect him. He is on a fixed income and can't afford to pay the penalties.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Affirm prior decision to decline to waive and offer a payment plan.
