RE:
Advisory Opinion Request from Jon Guice, on behalf of the Acadia Parish School Board (the "School Board") as to whether the Code of Governmental Ethics (the "Code") permits a School Board member to be appointed head coach of an athletic team for Crowley Middle School.
Facts:
Glenn Quebedeaux currently serves as School Board Member, District 4, in Acadia Parish, having been elected in the October 14, 2023 election. The School Board is trying to form a baseball team at the School, a school under the jurisdiction of the School Board. The School has been unable to find someone to serve as head coach. Mr. Quebedeaux would be interested in serving in that role on a volunteer basis.
The appointment of a head coach for middle school teams is delegated from the School Board to the individual schools.
Law:
La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.
La. R.S. 42:1113A states that no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
La. R.S. 42:1123(30) provides that a public servant, a legal entity in which he has a controlling interest, or a member of his immediate family may donate services, movable property, or funds to his agency. This provision shall not be construed to allow a public servant to make an appointment of a person which is otherwise prohibited by the Code.
La. R.S. 42:1102(2)(a)(vi) defines "agency" to mean, for public servants of political subdivisions, it shall mean the agency in which the public servant serves, except that for members of any governing authority and for the elected or appointed chief executive of a governmental entity, it shall mean the governmental entity. Public servants of political subdivisions shall include, but shall not be limited to, elected officials and public employees of municipalities, parishes, and other political subdivisions; sheriffs and their employees; district attorneys and their employees; coroners and their employees; and clerks of court and their employees.
La. R.S. 42:1102(19) defines "public servant" to mean a public employee or elected official.
Recommendations:
Adopt proposed advisory opinion.
