Ms. Trusclair states she dealt with health issues as well as family health issues and financial strain. She underwent surgery in October 2022 and has saw a counselor between May 2023 through December 2023, and intermittently in 2024. She also was assisting her daughter who was a first-time mother and her granddaughter with preparation with graduation and college.
Initial Waiver Request
Charlene Trusclair states this is her first late fee and untimely filing. Her husband, Kenneth Trusclair, received and misplaced the notice. During that time, Ms. Trusclair had many visits to the doctor to keep her diabetes and other health issues under control. In her position at DCFS, she had federal and state deadlines that required her to work late hours during the week and work some weekends. Ms. Trusclair requested a copy of the Late Fee Order and was informed that she could submit a waiver request. She is a first-time board member and is still learning the process. Ms. Trusclair believed her membership did not expire until 5/31/2024. If she had been familiar with the filing process, her documents would have been submitted on time.

La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
