Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Chris Martin and/or his father's company from transacting with Downsville Community Charter School while Chris Martin is an employee of the charter school.
Facts:
Chris Martin currently serves as a substitute bus driver for the Downsville Community Charter School and wants to apply for a position with the transportation staff or as a transportation supervisor. The bus drivers for the school currently use Mr. Martin's father's business to work on the school buses. The drivers contact Mr. Martin and/or his father with any issues on the school buses.
Law:
La. R.S. 42:1113A(1)(a). No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed Advisory Opinion.
