Advisory Opinion request as to whether the Code of Governmental Ethics ("Code") permits Darryl Hurst to serve as a member of the Crime Prevention & Improvement District while also serving as a councilman for East Baton Rouge Parish Metro Council. |

Mr. Hurst currently serves as a councilman for the City of Baton Rouge and the Parish of East Baton Rouge. He would like to serve as a member of the Crime Prevention and Improvement District for the Monticello Subdivision. The Crime Prevention and Improvement District is a political subdivision of the state as defined in the Constitution of Louisiana. The district is established for the primary object and purpose of promoting and encouraging the beatification, security, and overall betterment of the district. The district is governed by a seven-member board of commissioners. The member of the East Baton Rouge Parish Metropolitan Council, whose district encompasses all or the greater portion area of the district, shall appoint one member. All members serve without compensation.

La. R.S. 42:1113A(1)(a) No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
