Proposed Disqualification Plan regarding John Heinen's employment with the Crowley Fire Department while his father, Ricky Heinen, serves as District Chief.
Facts:
The Crowley Fire Department is headed by Chief Louis Romero, Jr. Chief Romero and Mayor Monceaux are involved in all hiring and firing for the Crowley Fire Department. The Department is divided into three shifts. Mr. Ricky Heinen is in charge of one of those shifts as District Chief-C shift. The District Chiefs are responsible for the day-to-day operations, including, but not limited to, disciplinary action suggestions. The Fire Department is looking to hire John Heinen, the son of Ricky Heinen, as a firefighter. As with all firefighters, decisions regarding disciplinary actions, promotions, and salary increases are made by Fire Chief Louis Romero Jr. and/or Mayor Chad Monceaux. In addition, all firefighters in the Crowley Fire Department are directly supervised by Drivers and Captains. As a further precaution, District Chief Ricky Heinen will be specifically instructed in writing by Fire Chief Louis Romero Jr. that he is not to be involved with his son's employment in matters affecting supervision, discipline promotions, and salary increases.

La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.

La. R.S. 42:1119: No member of the immediate family of an agency head shall be employed in his agency.

Recommendations:
Adopt the proposed Advisory Opinion and approve the Disqualification Plan.
